What Employers Need to Know

The Health Connector will be issuing an Administrative Bulletin Friday, August 15, 2014 describing the creation of a time-limited qualifying event for individuals currently enrolled in or eligible for COBRA coverage.  In accordance with guidance issued on May 2, 2014 by the Department of Health and Human Services, this bulletin provides guidance in connection with the open enrollment period, which ended on March 31, 2014 for the commercial non-group market.  Specifically, the bulletin provides (a) administrative information regarding an additional circumstance that would allow a person to enroll in coverage after March 31, 2014 and (b) clarification on the parameters of this special enrollment period.

What does this new guidance allow for?

As you may know, once a non-group open enrollment period closes (such as the one that concluded on 3/31/14), a person may only enroll in or make changes to their health insurance plan if they experience a triggering or qualifying event.  Triggering events include, but are not limited to the following: birth or adoption of a child, marriage, loss of insurance through a job, recently moved to the state, or recently became a citizen, national, or lawfully present individual.

In addition, a special enrollment period is created when a person is initially eligible for Consolidated Omnibus Budget Reconciliation Act ("COBRA") coverage due to a loss of minimum essential coverage and when a person's COBRA coverage is exhausted.  However, because people eligible for or enrolled in COBRA may not have known of their option to enroll in coverage through a Marketplace (such as the Health Connector), the Health Connector is designating the following additional circumstance as a triggering event: people who are eligible for or enrolled in COBRA coverage and want to cancel their COBRA coverage to purchase a Health Connector plan.

If someone meets such a circumstance, they will have sixty (60) days from the date of the Administrative Bulletin's issuance (scheduled for Friday, August 15, 2014) to enroll in coverage through the Health Connector.  The Health Connector is designating this triggering event in accordance with its authority pursuant to federal regulations at 45 C.F.R. ยง155.420(d).

FRAUDULENT COUPON ALERT
