LEGISLATIVE PROPOSALS FILED ON BEHALF
OF THE MASSACHUSETTS FOOD ASSOCIATION
FOR THE 2006 - 2007 LEGISLATIVE SESSION

  • H179 - AN ACT RELATIVE TO ITEM PRICING.
    This legislation seeks to gain further relief from the state's item pricing laws and regulations for food retailers, similar to the application system in Connecticut. A food retail location could successfully apply annually for a waiver to the state's item pricing requirements if they maintain a high price accuracy rate (98%) and install self scanners throughout the store for customers to check and verify prices of items.

  • H241 - AN ACT REGULATING CERTAIN CONSUMER PRODUCT PRICING.
    This legislation seeks to offer retailers the same relief from item pricing requirements for in-aisle products that they are presently allowed to use at their end-aisle displays for items that are the same size, price and brand, but differ only by flavor, color or scent.

  • H240 - AN ACT RELATIVE TO CONSUMER PRODUCT PRICING PRACTICES.
    This legislation seeks item-pricing relief for such items as candy, gum, chips and nuts and other assorted small items that are located in the checkout aisle and offered for sale individually. Presently, only those small items that weigh less than three ounces and cost seventy-five cents or less are exempt. This bill would lift these restrictions.

  • H157 - AN ACT RELATIVE TO CONSUMER PRODUCT PRICING.
    This legislation would require food stores to only item price grocery items rather than all items in the store that are not exempt, to level the playing field with non-food stores that only have to price mark grocery items..

  • H3310 - AN ACT TO UPDATE THE BOTTLE DEPOSIT SYSTEM AND LOWER THE COST OF RECYCLING BEVERAGE CONTAINERS IN THE COMMONWEALTH.
    This legislation seeks to phase out the state's bottle deposit system and allow cities and towns to reap the benefits from recycling those containers while expanding the state's municipal recycling infrastructure. The legislation would stimulate the creation of an appropriate solid waste management infrastructure and expand access and participation of residential and commercial comprehensive recycling programs through cooperative business and government participation.

  • H239 - AN ACT RESTRICTING THE SALE OF CERTAIN ITEMS AT FLEA MARKETS.
    This bill would restrict sales of OTC drugs, cosmetics and certain medical devices at flea markets, and will be used as a vehicle to spur discussion with law enforcement officials on organized retail crime, the sophisticated methods used for such theft, and its devastating effects on the retail industry.

  • H1791 - AN ACT TO AMEND THE CHILD LABOR LAWS.
    A newly enacted child labor law (Chapter 426 of the Acts of 2006) created a civil penalty structure for child labor violations, but did not differentiate between the severities of violations with regards to the fine structure. This proposal differentiates between "willful" violations and "non-willful" violations, such as having a minor punch a time clock out a few moments late as opposed to operating a forklift.

  • H780 - AN ACT RELATIVE TO COUPON USE FOR THE PURCHASE OF MILK
    This legislation would allow for consumers to purchase or obtain any type of milk via a coupon, promotion or sampling. Presently, only flavored milk can be purchased with the use of a coupon in Massachusetts.

  • H1531 - AN ACT CREATING A FINE STRUCTURE FOR THE THEFT OF MILK CRATES
    This legislation sets up a fine structure for anyone who steals so-called "milk crates" with fines increasing for the number of crates that have been stolen.

  • H180 - AN ACT ALLOWING RETAIL STORES TO OPEN ON THANKSGIVING DAY
    This legislation would allow retail stores to open on Thanksgiving day, presently a close all day holiday.
